These Terms of Service ("Terms") govern your access to and use of Kaption, including the website at https://kaption.in, accounts, applications, AI-assisted tools, uploads, downloadable outputs, team features, and related services (together, the "Service").
By creating an account, purchasing a plan, or using the Service, you agree to these Terms and the policies linked from them. If you use Kaption for a company, team, or other organisation, you confirm that you have authority to accept these Terms for that organisation.
If you do not agree, do not create an account, purchase a plan, or use the Service.
Kaption is a digital service operated by Yagna Patel, an individual proprietor based in Gujarat, India.

You must be at least 18 years old and legally able to enter into a binding agreement. You may not use the Service if applicable law prohibits you from doing so.
A person accepting these Terms for an organisation confirms that the organisation has authorised them to act on its behalf.
Account information must be accurate and kept up to date. You are responsible for protecting passwords, sign-in methods, recovery details, and access granted to team members.
Do not share credentials outside authorised users or allow another person to impersonate you. You are responsible for activity carried out through your account unless applicable law provides otherwise.
Notify support@kaption.in promptly if you suspect unauthorised access or a security incident.
Kaption is an AI-powered software service that may provide automatic captions, transcription, subtitle generation, video and media processing, social-media content generation, AI-assisted content tools, downloadable outputs, subscriptions, usage minutes, and team functionality.
Available features can differ by plan, language, region, device, file type, and product version. A feature described on this page may not be available to every account.
Kaption may offer free and paid plans. Each plan may have limits on minutes, file size, storage, exports, resolution, team seats, AI features, or other usage. Current plan details are shown on the pricing page, in the account, or at checkout.
Usage is measured using the method shown for the relevant feature or plan. Attempts to avoid limits, divide one account into artificial accounts, or otherwise obtain unpaid usage are prohibited.
If you purchase a subscription, you authorise the payment method selected at checkout to be charged for the price, billing period, applicable taxes, and any clearly accepted add-ons.
Billing frequency, currency, included usage, and the amount due must be shown before purchase. Keep billing information current. If a payment fails, access to paid features may be limited while payment is outstanding.
Kaption subscriptions automatically renew. Unless you cancel before the next renewal date, the selected payment method may be charged for the next billing period at the price and frequency disclosed for the subscription.
Renewal information and the next billing date should be available at checkout or in the account billing area.
You may request cancellation using the account or billing controls made available for your plan, or by contacting support@kaption.in.
Cancellation normally affects future billing and does not by itself reverse a completed charge. Cancellation and refund eligibility are explained in the Refund and Cancellation Policy. These Terms do not remove refund or cancellation rights required by law.
Kaption may offer extra usage minutes, team seats, storage, exports, or other add-ons. The quantity, price, expiry, and applicable limits must be shown before purchase.
Under the current configuration, unused included minutes do not roll over into the next billing period.
Add-ons are tied to the account or workspace for which they are purchased and may not be transferred or resold unless Kaption expressly permits it.
Prices may be exclusive or inclusive of taxes as shown at checkout. You are responsible for taxes, duties, or government charges that apply to your purchase, except taxes imposed on Kaption's income.
Kaption does not claim a GST number, CIN, or other registration number unless that number is expressly added to the legal configuration and displayed.
You may upload videos, audio, images, voice recordings, text, subtitles, fonts, project files, and other material ("User Content") for processing.
You must have all rights, licences, permissions, and consents needed to upload, store, process, transform, and export User Content, including permissions relating to copyright, music, voice, likeness, privacy, confidential information, and personal data.
Kaption does not claim ownership of your original uploaded videos, images, voice recordings, text, or other User Content.
As between you and Kaption, you retain the ownership rights you already hold in your original User Content. These Terms do not give you rights in third-party content merely because you uploaded or processed it.
You grant Kaption a limited, non-exclusive licence to host, copy, transmit, process, transform, format, and deliver User Content only as reasonably necessary to:
- provide the features and outputs you request;
- store and move files through the service infrastructure;
- support, secure, and troubleshoot the Service;
- enforce these Terms and prevent misuse; and
- comply with applicable law and valid legal requests.
This licence is operational only. It does not allow Kaption to sell your original User Content or claim ownership of it. It ends when the content is deleted from Kaption's systems, subject to reasonable processing time, backups, security records, and legal retention.
The Service may produce captions, transcripts, subtitles, translations, clips, titles, summaries, social-media material, or other AI-assisted results ("Output") from your instructions and User Content.
Output may not be unique. Other users may receive similar results, and Kaption does not guarantee that Output is eligible for intellectual property protection or free from third-party claims.
Kaption does not promise 100% accuracy. Captions, transcripts, translations, speaker labels, timestamps, summaries, generated media, and other Output may be incomplete, incorrect, misleading, or unsuitable for a particular purpose.
Accuracy can be affected by audio quality, accents, dialects, background noise, overlapping speech, technical vocabulary, file quality, language support, and AI limitations.
Do not rely on Output as professional legal, medical, financial, safety, accessibility-compliance, or other specialist advice. You are responsible for the final content you publish and for confirming that it is lawful, accurate enough, and appropriate for its audience.
Kaption and its licensors retain their rights in the Service, software, source code, interface, branding, documentation, workflows, and Kaption-created materials. Except for the limited right to use the Service under these Terms, no Kaption intellectual-property rights are transferred to you.
You may not copy, reverse engineer, distribute, sell, sublicense, or create a competing service from protected parts of Kaption except where applicable law expressly permits it.
Fonts, templates, music, stock media, plugins, and other assets may be owned by Kaption, a user, or a third party. Separate licence terms may apply and may limit commercial use, redistribution, modification, or the number of users.
You are responsible for checking the licence for assets you upload or select. Kaption's ability to process an asset does not confirm that you have permission to use it.
You must not use Kaption unlawfully, harm or harass others, process content without permission, introduce malicious code, bypass security or usage controls, scrape the Service, interfere with availability, impersonate others, or use automation outside documented interfaces.
The Acceptable Use Policy forms part of these Terms and gives further detail.
Do not upload or process material that infringes copyright or other intellectual-property rights. Kaption may restrict identified content or accounts when it receives a credible notice or is otherwise required to act.
Copyright notices must follow the Copyright and Takedown Policy and be sent to copyright@kaption.in.
Kaption may temporarily restrict an account, workspace, upload, or feature when reasonably necessary to investigate misuse, prevent security harm, protect users or third parties, address failed payment, enforce usage limits, or comply with law.
Where appropriate, Kaption may notify you and provide a reasonable opportunity to correct the issue. Urgent action may be taken without advance notice where delay could cause harm or legal non-compliance.
You may stop using Kaption and request account closure. Kaption may terminate access for a material or repeated breach of these Terms, unlawful conduct, serious security risk, non-payment, or where the Service can no longer lawfully or reasonably be provided.
Terms that by their nature should continue—including ownership, payment obligations, disclaimers, liability provisions, indemnity, and dispute terms—continue after termination.
Account settings distinguish subscription cancellation, individual project deletion and complete account deletion. Complete deletion requires a signed-in session, an email verification code, a one-time security token and the typed word DELETE. After acceptance, Kaption disables the account and revokes signed sessions, queues project and media deletion, requests Cashfree cancellation for an active subscription and anonymises the profile after required provider steps succeed.
Kaption targets account deletion within 30 days, subject to provider processing and limited legal, accounting, security, fraud-prevention, dispute and backup retention.
Uploaded project files are scheduled for deletion after 30 days under the current retention configuration.
Export important files before closing an account. Kaption is not a permanent archive or backup service. Invoices, tax records, payment references, fraud-prevention records and unresolved grievances may be retained where reasonably necessary or legally required, as explained in the Privacy Policy.
Kaption may rely on or connect with third-party hosting, storage, authentication, payment, email, AI, analytics, social-media, or media services. Confirmed providers are disclosed in the Privacy Policy where appropriate.
Third-party services may have their own terms, privacy notices, availability, and technical limits. Kaption does not control those services and is not responsible for third-party changes or failures beyond the extent required by law.
Kaption may add, change, limit, or discontinue features as the product, technology, legal requirements, or service providers change. Where a material change significantly affects an active paid plan, Kaption should provide reasonable notice when practicable.
Kaption aims to provide a reliable Service but does not guarantee uninterrupted availability. Maintenance, updates, internet failures, capacity limits, security incidents, and third-party outages may interrupt access or delay processing.
Keep independent copies of source media, projects, captions, and completed outputs.
To the extent permitted by applicable law, the Service and Output are provided on an "as available" basis. Kaption does not guarantee that every feature or Output will be error-free, accurate, secure, uninterrupted, or suitable for a particular purpose.
Nothing in these Terms excludes warranties, consumer rights, or other protections that cannot lawfully be excluded.
To the extent permitted by law, Kaption is not responsible for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, business, goodwill, or data, arising from use of or inability to use the Service.
This limitation does not apply where liability cannot legally be limited, including any mandatory consumer protection. No unconfirmed monetary liability cap is stated in these Terms.
To the extent permitted by law, you agree to indemnify Kaption and its personnel against third-party claims, losses, and reasonable costs arising from your unlawful User Content, your infringement of third-party rights, your misuse of the Service, or your material breach of these Terms.
This obligation does not apply to the extent a claim was caused by Kaption's own unlawful conduct, and it does not reduce rights that cannot be waived under applicable law.
These Terms are governed by the laws of India, without overriding mandatory protections that apply to you under other applicable law.
Courts located in Courts at Modasa, Gujarat, India have jurisdiction, subject to any mandatory right to bring a claim elsewhere.
Before beginning formal proceedings, please send a written description of the dispute and the requested resolution to grievance@kaption.in. The parties should make a reasonable effort to resolve the issue directly.
This section does not prevent either party from seeking urgent relief or using a court, regulator, consumer forum, or other process that cannot lawfully be restricted.
Kaption may update these Terms when the Service, law, pricing model, or business practices change. The current version is identified by the last-updated date at the top of this page.
Material changes may also be communicated through the Service or an appropriate account contact channel. Continued use after updated Terms take effect means you accept them, except where law requires a different form of consent.
