This Acceptable Use Policy applies whenever a person accesses or uses Kaption, including to upload, process, transform, generate, publish, download or distribute media, captions, transcripts, subtitles, social content or other outputs. It forms part of the Terms of Service.
Users are responsible for their account activity, instructions, uploads and final outputs. Before using Kaption, a user must have the legal rights, permissions and consents needed for the intended processing and publication. A user must review generated output and must not use Kaption to assist conduct prohibited by this policy.
If a user acts for an organisation or team, the user must follow both this policy and any additional rules that organisation lawfully applies to its workspace.
You must not use Kaption to upload, process, generate, publish or distribute content, instructions or activity that:
- is illegal under applicable law;
- facilitates, solicits or meaningfully assists unlawful conduct;
- violates a court order, legal restriction or lawful protection intended to protect another person; or
- is designed to conceal the source, participants or proceeds of unlawful activity.
The fact that content can technically be captioned, translated, edited or generated does not make its use lawful.
You must never use Kaption for:
- child sexual abuse material or any content that sexually exploits, sexualises, grooms, traffics or endangers a child;
- attempts to create, transform, caption, locate, exchange or conceal such material;
- non-consensual intimate images, audio or video, including synthetic or altered intimate content;
- sexual extortion, threats to disclose intimate material, or content intended to facilitate such abuse; or
- content captured, uploaded or distributed without the permissions required by law.
You must not use Kaption to:
- expose, misuse or unlawfully process another person's private, confidential or personal information;
- process recordings, voices, faces, likenesses or conversations without a lawful basis and any required permission;
- upload or distribute copyrighted videos, music, images, text, fonts, templates or other material without permission or another valid legal right;
- infringe trademarks, publicity rights or other legal rights; or
- use content that violates third-party platform rules, including the applicable rules of a social network, marketplace or media host.
Copyright reports should follow the Copyright and Takedown Policy. Transcribing, translating or transforming third-party material does not create permission to use it.
You must not use Kaption to create or assist:
- phishing pages, messages or deceptive credential requests;
- scams, fraudulent offers, fake support messages or misleading payment requests;
- impersonation intended to deceive, defraud or materially harm another person or organisation;
- identity theft, false account verification or identity fraud;
- forged evidence, fabricated endorsements or deceptive statements about a person's actions; or
- concealment or laundering of the source of fraudulent content.
Parody, satire and clearly labelled fictional work are not prohibited merely because they use imitation, but they must not be presented in a way intended to cause unlawful deception or harm.
You must not use Kaption to:
- harass, stalk, dox, intimidate, shame or coordinate abuse against a person;
- communicate or amplify a credible threat of violence or serious harm;
- incite others to target a person or group with violence or unlawful discrimination;
- create hateful or discriminatory abuse directed at people because of protected or vulnerable characteristics; or
- repeatedly contact a person who has clearly withdrawn consent where continued contact is unlawful or abusive.
Documentary, educational, counterspeech or newsworthy material may discuss harmful conduct, but context does not excuse content used to threaten, praise or facilitate that conduct.
You must not use Kaption to create or distribute actionable instructions where the purpose is to cause serious unlawful harm. This includes instructions intended to facilitate violent attacks, sexual exploitation, trafficking, serious physical injury, sabotage, destructive intrusion, or another comparably serious offence.
Legitimate education, reporting, safety research and prevention may discuss risks at an appropriate level, but must not be a pretext for enabling unlawful harm.
You must not use Kaption to upload, distribute or assist:
- malware, ransomware, spyware, destructive code or files intended to compromise a device, account or service;
- credential theft, unauthorised access, security-control evasion or harmful exploitation;
- use, sale or distribution of stolen account credentials, session tokens, payment-card details or other stolen payment information;
- publication of private security keys, passwords or access credentials without authority; or
- denial-of-service activity or instructions intended for a harmful attack.
You must not:
- use Kaption to generate or distribute unsolicited bulk messages, repetitive spam or deceptive engagement;
- bulk-create accounts, projects or requests to obtain unfair or unauthorised access;
- scrape, crawl or automate the service outside documented interfaces in a way that harms Kaption or other users;
- use bots or scripts to manipulate usage, referrals, rankings, reviews or engagement; or
- send automated traffic that disrupts availability or consumes unreasonable shared capacity.
You must not attempt to:
- bypass plan limits, usage minutes, file limits, rate limits, workspace limits or payment requirements;
- divide usage across artificial accounts or misrepresent eligibility to obtain unpaid access;
- reverse engineer, decompile or extract protected source code or models except where applicable law expressly permits it;
- probe, attack or bypass authentication, access controls, signed links, account ownership checks or other security measures;
- access another user's account, uploads, projects or outputs without authorisation;
- interfere with Kaption's infrastructure, providers, APIs or normal service operation; or
- conceal the source of abusive traffic or provide false information during an investigation.
You must not use Kaption to create, alter, caption, translate, publish or distribute synthetic or manipulated media that is deceptively presented as an authentic recording where that deception creates a material risk of fraud, violence, unlawful reputational harm, harassment, voter deception, market manipulation or another serious harm.
Where context makes the nature of media unclear, use accurate labels, disclosures or surrounding explanation appropriate to the audience. A disclosure does not make otherwise illegal or abusive content acceptable.
Kaption does not promise that it can detect every policy violation. Users remain responsible for their content and conduct.
When Kaption receives a specific report or identifies a security or operational incident, it may assess the information supplied in the report and the account, project or technical records reasonably available for that investigation. This responsive assessment is not a claim that Kaption routinely watches or manually reviews every upload.
If Kaption later introduces automated moderation or broader review processes, the relevant policies and privacy disclosures should be updated before those processes are used.
Report suspected abuse to support@kaption.in. Include, where available:
- the relevant public URL, project reference or account details;
- the type of suspected violation;
- when the activity occurred or was discovered;
- a concise explanation of the harm or risk; and
- supporting screenshots or records that you may lawfully share.
Do not send passwords, authentication tokens, full payment details, illegal copies of reported material or unrelated personal information. Copyright notices should use the Copyright and Takedown Policy and copyright@kaption.in.
Urgent grievances or unresolved reports may be submitted through the Contact and Grievance page.
While investigating a credible report, protecting a person, limiting security risk or complying with law, Kaption may temporarily:
- block an upload, download or public link;
- limit a feature, workspace action or processing request;
- remove or restrict access to identified content;
- require account verification or a security reset; or
- pause activity associated with a suspected violation.
Where reasonably possible, restrictions should be targeted to the affected content, feature or account and last only as long as needed for the relevant protective or investigative purpose.
Kaption may suspend an account or workspace where there is a reasonable basis to believe that continued access creates a serious legal, safety, security, fraud or service-integrity risk, or where a material or repeated violation requires further investigation.
Where circumstances allow, Kaption should consider the severity, intent, repetition, likely harm, user history and whether a narrower restriction would be effective. Advance notice may not be possible where delay could increase harm, compromise an investigation or violate a legal obligation.
Kaption may terminate an account for a severe violation, repeated violations after warning or restriction, deliberate evasion of enforcement, unlawful use, serious threats to users or systems, child exploitation, non-consensual intimate content, fraud, or another breach that cannot reasonably be addressed through a lesser measure.
Termination may remove access to projects and outputs. Users should not rely on Kaption as a permanent archive. Data handling after termination is governed by the Privacy Policy and the Terms of Service.
Kaption may preserve relevant account, upload, communication and technical records where reasonably necessary for an active investigation, dispute, legal hold, evidence-preservation duty or other requirement under applicable law. Preservation does not mean the material will remain available for ordinary product use.
Kaption may cooperate with a court, regulator, law-enforcement body or other authority when it receives a legally valid request or is otherwise required by applicable law. Where permitted and appropriate, Kaption should assess the request's authority, scope and connection to the information sought and disclose only what the lawful request requires.
Kaption does not promise to notify a user when notice is prohibited by law, would create a safety risk or could compromise a lawful investigation.
A user who believes a restriction, suspension or termination was mistaken or disproportionate may request review through the Contact and Grievance page or by emailing grievance@kaption.in.
The request should identify the account, affected action and reasons for review, and should include relevant evidence. Do not create replacement accounts to evade an active restriction while review is pending.
Where reasonably possible, a review should consider the available information, the policy section involved, severity, context and whether a narrower action is appropriate. Kaption does not promise a particular outcome or a fixed review period that has not been configured.
